1. Introduction and Agreement to Terms
These Terms of Use ("Terms") govern your use of our virtual paralegal services and website. By accessing or using our services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not use our services.
2. Our Services
We provide virtual paralegal support services exclusively to licensed attorneys and law firms ("Clients"). We do not provide services directly to the general public. Our services are limited to the performance of paralegal duties as delegated and supervised by a licensed attorney.
3. No Attorney-Client Relationship or Legal Advice
- No Legal Advice: Affinity Paralegal Professionals does not provide legal advice. We are not attorneys, and our services are not a substitute for the advice of a licensed attorney. We cannot represent clients in court, sign legal documents, or set legal fees.
- No Attorney-Client Relationship: No attorney-client relationship is created between us and any visitor to our website, or with any client or prospective client of the attorneys we serve. All legal services and decisions remain the sole responsibility of the supervising attorney.
4. Client Responsibilities
- Supervising Attorney: All work performed by Affinity Paralegal Professionals is done under the direction and supervision of a licensed attorney. It is the attorney's responsibility to maintain a direct relationship with their client and to assume professional responsibility for all work products.
- Accuracy of Information: The attorney-client is responsible for providing accurate, truthful, and complete information necessary for us to perform the requested services. We are not responsible for any errors or omissions resulting from inaccurate information.
5. Confidentiality
We are committed to preserving and protecting the confidences and secrets of our Clients, consistent with the ethical obligations of the legal profession. We will not disclose any confidential information without your consent, except as required by law. We use secure, digital platforms to protect all information.
6. Payment for Services
- Invoicing: We will provide invoices according to the payment schedule agreed upon with the Client. Invoices will specify the services rendered and the associated fees.
- Expenses: Any expenses, such as filing fees or document costs, are the responsibility of the Client and will be billed separately.
7. Limitation of Liability and Disclaimer of Warranties
- "As Is" Basis: All services are provided on an "as is" and "as available" basis without warranties of any kind. We do not guarantee legal outcomes or results of any document or service.
- Limitation of Liability: Affinity Paralegal Professionals will not be liable for any direct, indirect, incidental, or consequential damages resulting from the use of our services. The Client agrees to indemnify and hold us harmless from any claims or costs arising from our services in connection with litigation.
8. Intellectual Property
Unless otherwise specified, all materials on our website and generated in our work, including text, logos, and trademarks, are our property. You may not use these materials without our prior written permission.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Colorado. Any disputes will be subject to the exclusive jurisdiction of the courts located in Denver, Colorado.
10. Termination
We reserve the right to terminate or suspend access to our services immediately, without prior notice, for any reason, including without limitation a breach of these Terms.
